Terms of Service

Version 1.2 — Effective 2026-04-13. Adds §3 Upload-Rights Attestation; existing users will be asked to re-consent on next login.

1. Who we are

WISDCON LLC (Florida, USA), operator of the KOSMOVIZ service. See Imprint.

2. What we provide

A browser-based service that converts MP3/WAV audio into MP4 videos using shader-based visualizers. Free and paid tiers, see Pricing.

3. Upload-Rights Attestation (Copyright & User Content)

Each time you upload audio, you explicitly attest — by ticking the Upload-Rights checkbox — that one of the following is true:

• You composed and own the work yourself, or
• It was generated by you using Suno AI or a similar tool, with applicable rights, or
• It is released under a license that permits derivative works (Creative Commons, public domain), and your use complies with that license, or
• You have obtained written permission from the rights holder(s).

Uploading material without the above constitutes misrepresentation under §512(f) DMCA / Art. 17 DSM Directive, may result in immediate account termination, and shifts any damages resulting from DMCA / copyright claims to you as the uploader.

We honor DMCA takedown notices and the equivalent EU Copyright Directive / DSA processes. Send notices to dmca@kosmoviz.com.

4. Acceptable use

• No content glorifying violence, sexually exploiting minors, or promoting hate.
• No attempts to reverse-engineer, scrape, or degrade the service.
• No resale of Free-tier resources.

5. Billing

Paid plans are billed monthly or annually via Paddle.com (Merchant of Record). Subscriptions renew automatically; cancel anytime from your account settings. No refunds for partial months except where required by EU consumer protection law.

6. Service availability

We target 99.5% availability but make no formal SLA. Free tier is provided as-is, may be rate-limited, and can be discontinued with 30 days notice.

7. Liability

To the maximum extent permitted by applicable law, WISDCON LLC's aggregate liability is limited to amounts paid to us in the 12 months preceding the claim. Nothing excludes liability that cannot be excluded under law (gross negligence, intent, consumer rights).

8. Termination

You may delete your account anytime. We may terminate accounts that breach these Terms, with reasonable prior notice except for severe breaches (copyright infringement, abuse).

9. Governing law

These Terms are governed by the laws of the State of Florida, USA. EU consumers retain the statutory protections of their country of residence. Disputes are resolved in the courts of Broward County, Florida or, at the consumer's option, in their home courts where mandated by law.

10. Changes

We may update these Terms; material changes will be announced via email at least 30 days before taking effect.
